The Velvet Swan, LLC (“we,” “us” or “our”) respects your concerns about privacy. This Privacy Notice describes the types of personal information we collect on websites, mobile sites, mobile applications and other digital services and products that are owned or controlled by us and that link to this Privacy Notice (collectively, our “Sites”), how and why we may collet, store and use the information, and with whom we may share it. This Privacy Notice does not apply to any linked website that is not owned by us. The Privacy Notice also describes the measures we take to safeguard personal information and how users can contact us about our privacy practices.

Personal Information

We obtain certain personal information through our Sites or offline. “Personal information” is information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or device. We collect or obtain the following categories of personal information about you. Categories and Examples of Information We Collect:

  • Identifiers.  We collect names, addresses, phone numbers, online identifiers, email addresses and account names (collectively, “Contact Information”) of customers and others when you communicate with us (including when you express an interest in obtaining information about us or our products and services and when you participate in activities on our Sites) or to provide our products and services. We may automatically collect your Internet Protocol address when you visit, use or navigate our Sites to improve our products, services and communications (see "More About Cookies" below).

  • Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)).  We collect names and Contact Information of customers to provide, improve and promote our products and services and for the other business purposes listed below. 

  • Commercial information.  We obtain transaction data, purchase history and financial details pertaining to our products and services to comply with our legal obligations, to provide and improve our products and services and for the other business purposes described below. We collect data necessary to process your payment if you make purchases, such as your payment instrument number (e.g., a credit card number) and the security code associated with your payment instrument.   • Internet or other similar network activity.  We collect information about how customers and other visitors browse or search our Sites, for our brands or for our products and services.  We use cookies to identify visitors. (See "More About Cookies" below.)

  • Geolocation data.  We collect and use generalized location information to improve our product offerings, to comply with our legal obligations and for the other business purposes listed below.

  • Profiles or inferences drawn from other personal information.  We may collect information reflecting a person’s preferences, characteristics or behavior in order to improve or promote our products or services or for the other business purposes described below.

The “personal information” categories disclosed in this Privacy Notice do not include: 

  • Publicly available information from government records.

  • De-identified or aggregated consumer information. We may use or disclose to any party de-identified or aggregated information (that is no longer personally identifiable) for any purpose. For example, we may share this aggregated data with our agents, advisors, advertisers and business partners. We also may disclose aggregated user statistics in order to describe our products and services to current and prospective business partners and to other third parties for other lawful purposes.

  • Information covered by sector-specific privacy laws, such as the Fair Credit Reporting Act (FCRA), the Gramm-Leach-Bliley Act (GLBA) or the California Financial Information Privacy Act (FIPA).

Sources of Personal Information

We may obtain the categories of personal information listed above from the following categories of sources:

  • Directly from you. For example, from forms you complete or products you purchase.

  • Indirectly from you. For example, from observing your actions on our Sites using cookies. 

  • From third-party service providers. For example, from obtaining demographic data from a third-party service provider to use for marketing analytics.

More About Cookies

When you use our Sites or open our emails, we may obtain certain information by automated means, such as through browser cookies, web beacons, device identifiers, server logs and other technologies. A “cookie” is a text file that websites send to a visitor’s computer or other Internet-connected device to uniquely identify the visitor’s browser or to store information or settings in the browser. A “web beacon,” also known as an Internet tag, pixel tag or clear GIF, links web pages to web servers and their cookies and may be used to transmit information collected through cookies back to a web server. 

We may use these automated technologies to collect information about your devices, browsing actions and usage patterns. Our Sites do not respond to “Do Not Track” signals or similar mechanisms or signals received from browsers as no standard mechanism has yet emerged and become universally accepted.

How We Share Personal Information

We do not sell or otherwise share personal information about you, except as described in this Privacy Notice. 

We share your personal information with the following categories of third parties:

  • Service providers.  We share your personal information with third parties that provide services for us, such as website hosting service providers, payment processors, web and data analytics providers, data storage service providers, sales and marketing tools, performance monitoring tools, communications service providers and legal and financial advisors.  These third parties are not authorized by us to use or disclose the information except as necessary to perform services for us or to comply with legal requirements.

  • Government entities.  We disclose information about you (i) if we are required to do so by law, regulation or legal process (such as a court order or subpoena), (ii) in response to requests by government agencies, such as law enforcement authorities, (iii) for the purpose of or in connection with legal proceedings, or otherwise for the purpose of establishing, exercising or defending our legal rights, or (iv) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation of suspected or actual illegal activity.

  • Per your request.  We may share information at your direction and request.

We may transfer any information we have about you in the event we sell or transfer all or a portion of our business or assets (including in the event of a merger, acquisition, joint venture, reorganization, dissolution, liquidation or other corporate restructuring). 

We do not disclose personal information of our users to third parties for their direct marketing purposes.

Sales of Personal Information

In the preceding twelve (12) months, we have not sold personal information. Our policy is that we do not and will not sell your personal information, unless you give us your consent or direct us to do so.  

How to Submit a Request Regarding Your Personal Information

We strive to keep your personal information accurate. To protect your privacy and security, we also will take reasonable steps to verify your identity before granting you access or enabling you to make updates or corrections. We will make reasonable efforts to consider your request to access, correct or delete your information. We do not discriminate against consumers for exercising any of the privacy rights discussed in this Privacy Notice.

How We Protect Personal Information

We maintain reasonable administrative, technical and physical safeguards designed to protect personal information against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use.  

Our Sites are hosted on the Wix platform. Wix provides the e-commerce platform that allows us to sell and show our products and services to you. Your data is stored through Wix’s data storage, databases and general applications. Wix stores your data on a secure server behind a firewall. Additionally, as mentioned under “Information We Collect or Obtain,” if you choose to complete a purchase through our Sites, your payment data will be processed through Wix’s direct payment gateway. Direct payment gateways adhere to the security standards, including data encryption, set by the Payment Card Industry Data Security Standards (“PCI DSS”), as managed by the PCI Security Standards Council, a global forum created by several well-known credit card brands. Wix notes, in its privacy notice, that it regularly maintains a PCI DSS certification and that it regularly monitors its systems for possible vulnerabilities and attacks and regularly seeks new ways and services to further enhance the security of its services and protection of its visitors’ and users’ privacy. PCI DSS requirements help ensure the secure handling of credit card information by our store and its service providers. Unfortunately, no system is 100% secure, and we cannot and do not ensure or warrant the security of any information you provide to us. To the fullest extent permitted by applicable law, we do not accept liability for unintentional disclosure of your information.

Our Sites may contain links to other websites for your convenience and information. Linked websites may have their own privacy policies or notices, which we strongly suggest you review if you visit any linked websites. To the extent any linked websites are not owned or controlled by us, we are not responsible for their content, any use of the websites or the privacy practices of the websites. The inclusion of a link to any third-party website does not imply an endorsement by us.

Children’s Personal Information

The Sites are designed for a general audience and are not directed to children under the age of 13. We do not knowingly collect or solicit personal information from children under the age of 13 through our Sites. If we become aware that we have collected personal information from a child under the age of 13, we will promptly delete the information from our records. If you believe that a child under the age of 13 may have provided us with personal information, please contact us as specified in the "Contact Us" section of this Privacy Notice.

Updates to This Privacy Notice

This Privacy Notice may be updated periodically and without prior notice to you to reflect changes in our personal information practices. We will notify you before materially changing the way we use your personal information. If this Privacy Notice is revised, we will update the date at the top of this Privacy Notice and post (or provide a link to) the updated version on our Sites.
